4. LICENSE TO USE THE PLATFORM

Forteefied grants you a limited, revocable, non-exclusive license to access and use this site for personal shopping purposes. Commercial scraping, resale, or reproduction of website content is strictly prohibited.

5. INTELLECTUAL PROPERTY & CONTENT OWNERSHIP

• All designs, logos, graphics, layout, and content are the intellectual property of Forteefied

• This includes AI-generated artwork inspired by Indian folk art traditions (Warli, Madhubani, Pattachitra)

• You may not copy, distribute, modify, or commercially exploit any material from this website without written permission

• Violation may result in legal action under the Indian Copyright Act, 1957 and relevant international treaties

6. PRODUCT INFORMATION & PRICING

• We strive to ensure accuracy in product descriptions, images, and pricing

• Images are for representation purposes; actual colors and placement may vary slightly due to screen and print differences

• Prices are inclusive of applicable Indian taxes unless stated otherwise

• Errors in pricing, if discovered after order placement, may result in cancellation with a full refund

7. ORDER ACCEPTANCE & CANCELLATION

• All orders are subject to acceptance and stock availability

• Confirmation does not constitute a legally binding contract until we dispatch the order

• We reserve the right to cancel any order due to:

  • Stock unavailability

  • Pricing errors

  • Suspected fraud

  • Legal/regulatory restrictions

You may cancel an order within 6 hours if it has not yet been processed.

8. SHIPPING & DELIVERY

• Products are usually shipped within 2–5 business days of order confirmation

• Delivery time varies by location, courier partner, and unforeseen events (e.g., natural disasters)

• Ownership and risk of loss pass to you upon delivery

9. RETURNS, REFUNDS & EXCHANGES

• Returns are accepted only for:

• Items must be returned unused and unwashed, in original packaging, within 7 days of delivery

• Refunds will be processed to your original payment method within 7–10 business days after quality check

• No refunds or exchanges for customized items or limited-edition drops unless defective

10. PAYMENTS

• Payments can be made via:

  • Credit/Debit cards (Visa/Mastercard/Rupay)

  • UPI/Wallets (PhonePe, GPay, Paytm)

  • Razorpay Payment Gateway

• Forteefied does not store any card details or banking credentials

• Invoices are auto-generated in compliance with GST laws

11. FRAUDULENT TRANSACTIONS & ACCOUNT SUSPENSION

We reserve the right to:

• Suspend or terminate accounts that engage in fraudulent returns, payment chargebacks, or misuse of promotions

• Involve relevant legal authorities in cases of identity fraud, payment reversal abuse, or spam ordering

12. LIMITATION OF LIABILITY

To the fullest extent permitted under Indian law:

• Forteefied and its affiliates, directors, partners, employees, and agents shall not be liable for any:

  • Indirect or consequential damages

  • Loss of profits, business, data, or goodwill

  • Delays or failures caused by third-party service providers

• Our liability, under any circumstance, shall not exceed the value of the product purchased by you

This limitation applies even if we were advised of the possibility of such damage and regardless of the form of action.

13. DISCLAIMER OF WARRANTIES

• All content, services, and products are provided “as is” and “as available” without warranties of any kind

• We do not guarantee:

  • That the website will be uninterrupted or error-free

  • That products will always meet expectations, especially in regard to sizing or color (refer to size chart & product description)

  • That your use of the platform will yield particular results

14. USER CONDUCT & SITE USAGE RESTRICTIONS

By using this website, you agree that you will not:

• Violate any applicable Indian or international law

• Use the site to transmit viruses, spam, or malicious code

• Use bots, crawlers, or data scraping tools

• Infringe upon our intellectual property rights

• All AI-generated artwork used in products is original, algorithmically created, and does not copy or infringe upon any known tribal artist’s work

• These artworks are used respectfully, ethically, and for commercial sale with full transparency (see Disclaimers)

• We are open to future collaboration with tribal artists or art collectives and welcome ethical partnerships

18. PRIVACY POLICY

Use of this platform is also governed by our Privacy Policy, which outlines:

• How we store and use data

• Your rights under Indian data protection laws

We comply with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

19. INDEMNIFICATION

20. TERMINATION

We may, at our sole discretion:

• Terminate or suspend your access without prior notice if you breach these terms

• Restrict access to users who abuse return/refund policies or engage in chargeback fraud

Termination does not affect rights or obligations already incurred prior to termination.

21. GOVERNING LAW & JURISDICTION

• These Terms shall be governed by and construed under the laws of India

• All disputes shall be exclusively subject to the jurisdiction of the courts of Bengaluru, Karnataka, regardless of your location

• We reserve the right to seek equitable relief in any competent court worldwide in cases of IP violation or defamation
